Employing expatriates in Nigeria: start with the quota

A Nigerian company cannot simply hire a foreign national and put them to work. The legal foundation is the expatriate quota — approval from the Federal Ministry of Interior for a set number of expatriate positions. Every work-based STR visa and CERPAC for your staff hangs off that quota. This guide explains how it works, how it connects to the rest of the immigration chain, and where the much-discussed Expatriate Employment Levy actually stands in 2026.

Honest note: RenewPapers is not the Ministry of Interior or the Immigration Service. Quota and expatriate approvals are granted by the government. What we do is prepare the company’s application, assemble the supporting corporate documents, and coordinate the quota with the STR/CERPAC process for each expatriate hire.

How the quota works

  • Positions, not people. The quota grants your company a number of approved expatriate positions (with job titles and qualification requirements). You then place individual expatriates against those slots.
  • It feeds the visa chain. With a quota position approved, your expatriate obtains the STR visa abroad, enters, and regularises to CERPAC. No quota, no lawful work residence.
  • Understudy & reporting. Quota positions typically carry Nigerian understudy and monthly expatriate reporting obligations — part of the government’s localisation aim.
  • Renewal. Quota is time-bound and renewed; lapses cascade into your expatriates’ permits.

Where the Expatriate Employment Levy stands

You may have heard of the Expatriate Employment Levy (EEL) — an annual per-expatriate charge announced in early 2024. Its implementation was suspended shortly after launch and has remained the subject of review and litigation. In practice, the operative requirement for employing expatriates remains the quota and the STR/CERPAC chain, not the levy. Because this is an area the government has signalled it may revisit, we confirm the current position before you plan around it.

Get the corporate documents in order first. Quota applications lean on your CAC incorporation, your tax clearance and evidence of real operations. Having these clean and current is half the battle — and we can sort them in the same engagement.
